Gary S. Matsko, Thomas S. Fitzpatrick and Judith Ashton Successfully Preserve After Trial Judgment in Massachusetts Appeals Court and Win Award of Appellate Fees and Costs

Davis Malm attorneys Gary S. Matsko, Thomas S. Fitzpatrick and Judith Ashton recently obtained from the Massachusetts Appeals Court an award of appellate fees and costs incurred by Davis Malm's clients in connection with efforts to successfully preserve a favorable judgment obtained after trial. The case involved shareholder disputes arising from two corporations. Davis Malm's clients were the majority owners of the corporations and were responsible for the management of those businesses. A minority shareholder brought suit challenging numerous transactions and seeking more than $2,000,000 in damages. The trial judge rejected the vast majority of claims advanced by the plaintiff and awarded the plaintiff a small percentage of the amounts that he claimed. It awarded Davis Malm's clients over $220,000 in attorneys fees and costs incurred in defending themselves against the minority shareholders claims at trial. The Appeals Court affirmed the judgment and awarded the additional fees to Davis Malm.
