Thomas S. Fitzpatrick Successfully Defends and Obtains Dismissal of Claims Alleged Against Senior Executive of Investment Banking Firm

Davis Malm attorney Thomas S. Fitzpatrick successfully defended and obtained the dismissal of a federal court action alleging fraud and breach of fiduciary duty by the former chief financial officer and treasurer of a Boston investment banking firm. The plaintiff in the case, a Hong Kong firm, claimed our client had participated in a scheme to defraud it of $4,000,000. Mr. Fitzpatrick and our client vehemently disputed those allegations but also contended that, even if true, any claims were barred by the statute of limitations. United States District Court Judge Rya Zobel agreed and granted Mr. Fitzpatrick's motion to dismiss. As a result, our client will avoid a long and expensive litigation.
