Davis Malm attorney Thomas S. Fitzpatrick successfully resolved a probate litigation matter on behalf of our client, the Administrator of an intestate estate. The prior administratrix of the estate failed to list two bank accounts in the estate inventory and insisted that the accounts had been a gift from the intestate. Mr. Fitzpatrick pursued a claim against the former administratrix in probate court and then negotiated a settlement, pursuant to which the former administratrix has now returned to the estate 100% of the funds, in excess of $270,000, as well as disputed personalty.
