Thomas S. Fitzpatrick Successfully Defends Mechanics Lien Suit

Davis Malm attorney Thomas S. Fitzpatrick successfully defended a developer client of the firm against a $100,000 mechanics lien claim. A subcontractor on our client's project recorded a mechanics lien against our client's property and commenced a lawsuit against both the contractor and our client. Mr. Fitzpatrick filed a counterclaim under the mechanics lien statute seeking an expedited determination of the validity of the lien. They then filed a summary judgment motion asking that the lien be summarily discharged. Upon receipt of Mr. Fitzpatrick's motion, counsel for the subcontractor agreed to voluntarily dissolve the lien and dismiss the claim against our client with prejudice.
