Thomas S. Fitzpatrick Wins Breach of Lease and 93A Case in Massachusetts Appeals Court Case

Davis Malm attorney Thomas S. Fitzpatrick recently won an appeal in the Massachusetts Appeals Court. His client, a commercial landlord, was accused by a tenant of having breached the lease and committing unfair and deceptive trade practices in violation of Massachusetts General Laws Chapter 93A. The tenant was seeking in excess of $7 million in damages. Mr. Fitzpatrick obtained a summary judgment ruling in the Middlesex Superior Court dismissing these claims. The tenant appealed, but the Appeals Court has now affirmed the dismissal of the claims.
