On January 22, Davis Malm shareholders Amy L. Fracassini, Brian L. Gaudet, and Donna M. White conducted a webinar, “Passport to Trusts & Estates: U.S. Issues for Canadian Estates,” which addressed tax and estate planning issues facing wealth and estate professionals in Canada. The presentation focused on transactional issues associated with purchasing property in the U.S.; transfer taxes applicable to non-citizens who are not domiciled in the U.S.; trust ownership issues of U.S. real estate; real estate tax obligations, particularly in rental and sale situations; and legal and tax issues in administering U.S. assets.

The program was hosted by the International Lawyers Network, and the Canadian law firms of Clark Wilson LLP in Vancouver and Fogler, Rubinoff LLP in Toronto also participated in the webinar.

Amy L. Fracassini practices in the Business Law and the Real Estate and Environmental areas. Her practice focuses on the representation of corporate clients in connection with sales and acquisitions of businesses, debt and equity financings, private placements, and real estate matters, including commercial leasing and purchase and sale agreements.

Brian L. Gaudet is a tax attorney with over 25 years of experience advising public and private companies and non-profit organizations in global, federal, and multi-state tax matters. She concentrates her practice in all areas of estate and trust administration and estate, gift, and generation-skipping transfer tax planning, with particular emphasis on leveraged gifting techniques and other wealth transfer tax planning strategies involving trusts and limited liability companies.
