On October 3, Davis Malm shareholder Tamsin R. Kaplan spoke on the panel for the American Arbitration Association’s national webinar, “What Really Happened? Investigating Workplace Discrimination and Harassment Complaints.” This program is critically important for all business owners, human resources professionals and employment lawyers. Ms. Kaplan and other panel members addressed best practices for conducting a neutral fact-finding investigation to resolve workplace discrimination and harassment complaints.

Ms. Kaplan discussed issues facing employers when they receive a complaint of workplace discrimination and harassment. She provided insights into the process of initiating an investigation, including challenges and potential pitfalls in communication with the accuser and the accused, choice of an internal or outside investigator, and interfacing with union leadership.

Tamsin R. Kaplan practices in the Business Law, Employment, and Litigation areas. Ms. Kaplan has extensive experience representing businesses, executives, and other high level professionals on a full range of employment-relates issues, including recruitment, hiring, discrimination, negotiation of employment agreements, breach of contract, non-competes, discipline, and termination. Ms. Kaplan has been on the Labor and Employment Curriculum Advisory Committee of the Massachusetts Continuing Legal Education since 2010, and is the author of the chapter on Employment Agreements in Advising Massachusetts Businesses, a book published by MCLE in 2011. She was recently distinguished as a Chambers USA "Leading Lawyer", has been included for several years in the list of Massachusetts Super Lawyers, and was selected by her peers for inclusion in The Best Lawyers in America© 2014.
