NLRB Poster Rule on the Shelf

In follow up to the alert we sent yesterday concerning the National Labor Relations Board's poster requirement, in a day of fast moving developments, a federal appeals court yesterday temporarily enjoined the implementation of the rule requiring employers to post a notice of employee rights under the National Labor Relations Act. Following the issuance of that injunction, the NLRB announced late yesterday afternoon that it will not implement the poster rule pending the resolution of the issues before the courts. The NLRB intends to appeal the adverse court rulings. It will take some time until a definitive ruling is issued. In the meantime, employers do not need to comply with the poster requirement. We will keep you advised of future developments.
