PRACTICE FOCUS AND EXPERIENCE


Robert Kaitz practices in the Employment and Litigation areas. Robert is a trial lawyer focusing primarily on employment, professional liability, and business litigation matters, as well as employment counseling. Robert represents clients in employment discrimination, wage and hour, and close corporation litigation. He assists employers in drafting and implementing company handbooks, restrictive covenants, and severance agreements and advises employees with regard to navigating employment contracts. Prior to joining Davis Malm, Robert was an associate at Boyle, Shaughnessy & Campo, P.C. He also served as Law Clerk to the Honorable Judith Fabricant and the Honorable Peter Lauriat, both in the Suffolk County Superior Court’s Business Litigation Session.

REPRESENTATIVE MATTERS


  • Obtained Land Court dismissal in a suit alleging client breached an offer to purchase agreement, demonstrating that plaintiff attempted to change material terms of the deal.
  • Successfully defended state agency sued for gender discrimination and retaliation in eight-day federal jury trial, resulting in verdict for the client on all counts.
  • Obtained defense verdict for attorney sued for legal malpractice after three-week jury trial.
  • Assisted in obtaining new trial following $4 million verdict in premises liability case due to opposing counsel’s misconduct during trial, including preparing post-trial motions and arguing motion for remittitur.
  • Obtained summary judgment in premises liability matter with $1.3 million demand.
  • Obtained dismissal of Charge of Discrimination at Massachusetts Commission Against Discrimination after an initial finding of probable cause.
